Terms of Service

These Terms of Service (“Terms”) govern your access to and use of BasePixel, including the websites at basepixel.io and app.basepixel.io and the related smart contracts on the Base blockchain (collectively, the “Service”), operated by BasePixel Labs (“BasePixel Labs,” “we,” “us,” or “our”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction (whichever is greater), to use the Service. By using the Service you represent that you meet this requirement and that you are not a resident of, or located in, any jurisdiction where your use of the Service would be prohibited by applicable law.

2. The Service

BasePixel is an on-chain game on the Base blockchain. You play by connecting a self-custodied wallet and signing transactions that interact with our smart contracts. We do not custody your wallet, your funds, or your in-game assets. Ownership, transferability, and on-chain state are governed by the smart contracts themselves.

3. Wallets and On-Chain Transactions

• You are solely responsible for securing your wallet, seed phrase, and private keys. Anyone with access to them can act as you.
• On-chain transactions are irreversible. We cannot reverse, refund, cancel, or modify a transaction once it has been broadcast or included in a block.
• Network gas fees and any other on-chain costs are paid by you to the Base network or to third-party infrastructure, not to us, and are non-refundable.

4. Acceptable Use

You agree not to:

• Use the Service to violate any applicable law or regulation.
• Attempt to disrupt, attack, or probe the Service or its supporting infrastructure beyond ordinary gameplay.
• Use bots, scripts, or automation to obtain an unfair advantage in a way that materially harms other players, beyond ordinary on-chain tooling.
• Engage in fraudulent, deceptive, or abusive conduct toward other users.
• Reverse-engineer, copy, or attempt to extract source code from the non-open-sourced parts of the Service.

5. Risk Disclosure

Blockchain technology is experimental. Smart contracts can contain bugs. Network conditions, congestion, validator behavior, and third-party services can affect transaction outcomes. The value of digital assets is volatile and can fall to zero. You understand and accept these risks. The Service is not a security, an investment product, or a financial service, and nothing on the Service is intended as financial, legal, or tax advice.

6. Intellectual Property

Except for content you contribute, the Service and the underlying software, designs, and branding are owned by BasePixel Labs or its licensors and are protected by applicable intellectual property laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.

7. User Content

If you submit content (e.g. pixel colors, in-game configurations, or public messages) through the Service, you grant BasePixel Labs a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as necessary to operate the Service. You are solely responsible for the content you submit.

8. Third-Party Services

The Service relies on third-party infrastructure (e.g. blockchain nodes, wallet providers, hosting and CDN). Those third parties operate under their own terms and we are not responsible for their acts or omissions.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, BasePixel Labs and its contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or digital assets, arising out of or in connection with your use of, or inability to use, the Service. BasePixel Labs’ aggregate liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) US $100.

11. Indemnification

You agree to indemnify and hold harmless BasePixel Labs, its contributors, and its affiliates from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

13. Changes to the Terms

We may modify these Terms from time to time. If we make material changes we will indicate the new effective date at the top of this page. Your continued use of the Service after the changes take effect constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws applicable to BasePixel Labs’ principal place of business, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Service that cannot be resolved informally will be resolved by binding individual arbitration; you waive any right to participate in a class action.
